A federal judge in Maryland made a very important decision. The judge said that immigrants with cases in Maryland cannot be deported right away after filing a special court request called a habeas corpus. This gives people at least two extra days to fight their case in court.
Why Does This Matter?
In the past, some people were sent back to their country so quickly that they never had a chance to talk to a judge or a lawyer. That’s not fair.
This new rule protects your right to stay in the U.S. while the court looks at your case. It gives everyone a chance to be heard and to get help from a lawyer.
What Is a Habeas Corpus?
It’s a legal paper you can file if you think the government is holding or deporting you unfairly. It asks a judge to look at your case. Now, if you file this paper in Maryland, the government must wait at least two business days before doing anything to change your immigration status or send you away.
Real Case: Kilmar Abrego García
This rule came after a man from El Salvador, Kilmar Abrego García, was deported even though the court said he shouldn’t be. He was sent to a dangerous prison in El Salvador and hasn’t been brought back, even though the U.S. Supreme Court said he should be. The Maryland judge doesn’t want that to happen to anyone else.
