At Whitaker Legal, we’re more than just immigration attorneys — we’re advocates for justice, defenders of human dignity, and believers in the promise of a future without barriers. That’s why we cannot stay silent as thousands of immigrants are being wrongly erased from existence in a disturbing new bureaucratic move by the U.S. government.

Recently, The Baltimore Sun uncovered that the Social Security Administration (SSA), following a directive under the Trump administration, moved over 6,000 living immigrants — many of them legally present — into the SSA’s “Ineligible Master File,” previously known as the “Death Master File.” The result? These individuals were officially declared dead — without notice, without due process, and without any way to respond.

Our founder and managing attorney, Nicole M. Whitaker, was quoted in the article expressing deep concern:

“Labeling thousands of living immigrants as deceased and revoking their Social Security numbers is not only a bureaucratic nightmare, it’s a chilling abuse of government power. This tactic essentially erases a person’s legal identity in the United States, potentially cutting off their ability to work, bank, access housing or drive. It’s the administrative equivalent of forced disappearance.”

For immigrants who have fled violence, persecution, or economic instability to seek a better life in the U.S., this is not just a technical error — it’s a life-altering crisis. Without a valid Social Security number, individuals can lose access to employment, housing, healthcare, and even their identity. The implications are not only legal but profoundly personal.

Whitaker continues:

“This isn’t immigration policy — it’s targeted, bureaucratic cruelty. If a sitting president can use federal agencies to weaponize administrative tools against a vulnerable population without due process or transparency, it opens the door for future governments to do the same to any group they wish to marginalize.”

At Whitaker Legal, we serve immigrants from more than 125 countries — many of them from Spanish-speaking countries in Central and South America. Our work is rooted in Biblical values: striving for excellence, serving humbly, and inspiring hope. The events described in this report are a direct affront to the principles we uphold and the clients we serve.

We urge our community, policymakers, and fellow advocates to speak out. This isn’t just about legal status — it’s about human rights, dignity, and the moral fabric of our democracy.
