At Whitaker Legal, we believe in fairness. That’s why we’re proud of our Managing Attorney, Nicole Whitaker, who recently spoke out in The Daily Record article about a big legal battle happening in Maryland. You can read the full article here.
The Trump Administration is now suing two federal judges. Why? Because those judges ordered ICE (Immigration and Customs Enforcement) to pause certain deportations — giving immigrants more time to go through the proper legal process.
Nicole Whitaker said this lawsuit “does not seem proper.” She shared that the judges are not doing anything wrong — they are doing their job: making sure people have the chance to present their case in court.
“What these judges are doing is trying to preserve due process,” Nicole said. “Their whole point is to stop ICE long enough, to halt these deportations long enough, to allow people to make their case in court. That’s not judicial overreach, that’s constitutional responsibility.”
Why This Is Important for Immigrants
Many people who come to the U.S. are escaping danger, violence, or abuse. Some qualify for special protections like:
- VAWA (Violence Against Women Act) – for people who were abused by a U.S. citizen or permanent resident.
- T Visa – for those who were trafficked into the U.S.
- Green card – for those who want to stay and live here legally.
Making sure every person has time to explain their situation is key to a fair process. The court should hear your full story before any decision is made — and that’s what these judges are helping protect.
